OFCC Sues City of Cleveland Heights, Ohio The sign you see here is posted in Cleveland Heights Parks implying possession of a firearm is a crime. On Friday August 12th, 2011 Ohioans For Concealed Carry Filed a lawsuit against the City the City of Cleveland Heights. The litigation comes after many attempts to resolve concerns over laws that Cleveland Heights not only allowed to remain on their books, but also posted signs at their parks that continue to imply it is illegal to be armed. The City of Cleveland Heights has chosen to ignore our attempts at civil discourse. When individuals have contacted them representing themselves as residents of the City of Cleveland Heights their concerns apparently fell on deaf ears. When representatives of the organization have formally contacted the city's legal representation they've been laughed at and hung up on by the Law Director. It is this arrogance and refusal to work with Ohioans For Concealed Carry that has forced us to seek a remedy through the courts.
Our press release follows.
Canton PD Event Leads to New OFCC Legislation When officer Harless of the Canton, Ohio police department came upon a vehicle stopped in the roadway most of us were focused on getting restaurant carry legislation signed into law. What took place that evening has become an international viral video, calls for the resignation of the City Council president, and criminal charges against a man who is clearly heard trying to state that he has a license. Ohioans For Concealed Carry has not just raised thousands of dollars in a legal defense fund, but we've written legislation to resolve this matter that Representative Danny Bubp has stated he's going to introduce this fall

Cleveland Gun Laws Fail: Another Teen Shoots Himself PDF Print E-mail

On March 14th, the first day of statewide firearms preemption in Ohio, the City of Cleveland issued a press release titled "City of Cleveland Fights for the Right to Protect its Children". This release announces the city's lawsuit against Ohio's enactment of statewide uniformity for firearm laws.

Mayor Frank Jackson argued in the release "Our gun laws were created to protect our children..." Ohioans For Concealed Carry has joined many scholars in arguing for years now that gun control laws do not protect anyone but the criminal by disarming those of us in society who follow laws.

Cleveland police announced on Tuesday night that a 16-year-old Cleveland boy shot himself in the head while supposedly demonstrating to his girlfriend that the gun "couldn't" fire with its safety engaged. Most gun owners know that you:

a) never trust a physical safety and

b) never point a gun at something you do not intend to destroy, like your brain or another human being.

Despite Mayor Jackson insisting that Cleveland shall illegally continue to enforce its draconian gun laws in defiance to Ohio's new statute, and without a court order staying the implementation, those very laws, all failed the City of Cleveland and the 16-year-old child who shot himself in the head.

OFCC Raises Awareness of Media Access Loophole PDF Print E-mail

A story, Pro gun journalist' seeks lists of permits was recently published by The Cleveland Plain Dealer that reports on Ohioans For Concealed Carry's attempt to further study the current media access loophole that exists in Ohio law permitting journalists to obtain the personal information of those that have obtained an Ohio Concealed Handgun License (CHL).

What the Plain Dealer didn't tell you is that OFCC has requested the same information that journalists request from Ohio Sheriffs for three reasons, including an effort to end the journalist loophole either through legislative reform or the courts.

The primary driving force behind this effort was to perform statistical analysis on a dataset of those that have received CHLs. To date, no one has undertaken such a project despite countless news media outlets having the authority to do something along these lines. Unlike anything the news media has done we feel such an analysis would truly benefit the public interest, a key requirement when requesting the information.

By the end of the day Thursday a lawsuit was filed in The Court of Common Pleas in Clermont County by a County Assistant Prosecutor in response not only to our request, but a last minute request by the Cincinnati Enquirer seeking the entire list of license holders before HB9 goes into effect was denied, for now, as well.

OFCC Attorneys Advise 6th District of Preemption PDF Print E-mail
Written by Jeff Garvas

Yesterday Ohioans For Concealed Carry's legal representation in Ohioans For Concealed Carry v. City of Clyde filed a motion with the court to bring to it's attention the fact that statewide preemption became law and had serious implications in the case. Ohioans For Concealed Carry is asking the 6th District Court of Appeals to return the case to the original court.

You can read the brief legal document here: Motion To File Supplemental Authority

Ohioans For Concealed Carry originally attempted to convince the City of Clyde council and other city leaders that posting "No Guns" signs in it's parks was in direct conflict with state law. Clyde had even adopted an ordinance for their signs and penalties.

As Expected: Cleveland Files Lawsuit Against HB347 PDF Print E-mail
Written by Jeff Garvas
Wednesday, 14 March 2007 03:17

Today, the City of Cleveland filed a declaratory judgment against The State of Ohio's attempts to modify Ohio Revised Code (RC) section 9.68 (as modified in HB347) in an effort to have it over turned.

We've acquired a copy of the 12 page complaint. City of Cleveland v. State of Ohio (may require latest version of Acrobat).

This means that Cleveland will be the first City to challenge statewide preemption, but appears not to jeopardy any other area of HB347 such as carrying concealed in a motor vehicle. At the time of this writing OFCC was not aware of any stays granted to Cleveland. Representatives from the City of Toledo have already promised to join in the suit, but have not yet taken action.
