I had a prior misdemeanor expunged from my record. Do I still have to answer Question #9 on the CCW application in the affirmative? PDF Print
HB12 creates an exception to Ohio's "sealed records", commonly referred to as expunged records, for persons conducting background checks on applicants under 2923.125 or 2923.1213. Although the statute on sealing of records states that the proceedings are deemed not to have occurred, or in the case of a bond forefiture, the charges are considered dismissed, you should be advised that the Sheriff will have authority to look into all sealed records.
