Brian Ballenger, law director for Northwood, followed through on his promise to contact us this week to continue working to resolve the Northwood Incident.
In a phone call with me yesterday, he again confirmed that his office is aware that open carry is legal, and that he has communicated that information to the Northwood Police Chief. Ballenger also reiterated that no charges were going to be filed against OFCC member Edwin Farbrother, an obvious fact since he broke no law.
However, he repeatedly stated that he advises against open carry to avoid panicking citizens who may not be aware that such an action is legal (although I pointed out that the last two people "panicking" were off-duty police officers).

Last week, the Law Director in Willowick also followed through with his promise to help us effect change at the statewide level by writing a letter to the Lake County Prosecutor asking Ohio Attorney General Nancy Rogers for an official opinion to be issued on the legality of open carry.
As of this time, we have received no response from the AG's office regarding our own letter sent earlier this month.
OFCC thanks Law Director John P. O'Donnell for his assistance.

Our friends in the Virginia Citizens Defense League, who have been at the forefront of the battle to restore gun rights in our National Parks, are circulating a Call For Action regarding the Department of the Interior's recent extension of the public comment period for a proposal to change park regulations to match the laws of the state where the park is located when it comes to firearms. Below is listed their memo, and we are happy to help them spread the word.
Let the games begin.
The Department of the Interior has extended the comment period on
allowing lawful carry of firearms in National Parks until August 8th
(it was supposed to end on June 30th).
Why?
Because pro-gun comments have dwarfed the anti-liberty crowd and there
are some, including some Congressmen, who don't like that.

Update: Brian Ballenger, law director for Northwood, has contacted OFCC. He said he is well aware of the fact that open carry is legal and wants to work with us to resolve this incident. As he is out of state all of next week, we agreed to pick this up the following week after he gets back.
Yet another Ohioans For Concealed Carry member experienced harassment from police ignorant of the laws in Ohio regarding open carry.
OFCC member Edwin Farbrother took his eighteen-year-old daughter out for ice cream on her birthday in the evening of Saturday, July 5th, 2008 in the City of Northwood. After being there for approximately ten minutes, a police car roared up and skidded to a stop. The officer approached a man later identified as an off duty police officer (department unknown at this time) who pointed Farbrother out to him. Farbrother knew immediately that the officer was there because he was openly carrying a firearm, and he was correct.
Farbrother immediately informed the officer that he had a concealed handgun license, but the officer was not interested in that. Instead, he immediately began berating Farbrother for openly carrying a gun where children were present, and told Farbrother that he was breaking the law by doing so. The off-duty officer and the uniformed officer continued to argue with Farbrother, despite his attempts to explain that open carry is legal. Soon after, a third officer showed up. |

The Chief of Police in Willowick has followed through with his promise to help us effect change at the statewide level by writing a letter to Ohio Attorney General Nancy Rogers.
His letter echoes the concern of our own, that there are misconceptions among many in law enforcement regarding the legality of open carry. We hope AG Rogers will help resolve the problem and ensure all law enforcement agencies in Ohio are aware of the fact that open carry by law-abiding citizens not otherwise restricted by law is perfectly legal.
OFCC thanks Chief Lazor for his continued support.

Florida's Attorney General is accepting complaints from citizens regarding businesses that violate state law by banning employees from keeping firearms in locked vehicles in company parking lots. Perhaps Ohio's Attorney General should follow suit and solicit complaints from law-abiding citizens who have been subjected to harassment by law enforcement for openly carrying a firearm in accordance with the State Constitution?

Those who have been following the Bryan Ledford story know that Ohioans For Concealed Carry has been working to educate both the public and law enforcement on the legality of openly carrying a firearm in Ohio.
That story was just the latest example of such an incident, and stories have continued to come forward regarding similar situations, both past and present.
In a follow up story, we noted that the Willowick police department confirmed that there is a widespread problem in the law enforcement community in Ohio regarding this issue. While "ignorance of the law is no excuse" seems to be frequently toted whenever a private citizen makes a mistake, it seems to hardly hold to be true in the other direction.
In light of the fact that these incidents continue to occur on a regular basis, and the very real threat of expensive legal battles to prove the innocence of a law-abiding citizen simply exercising his or her rights under the Ohio Constitution, OFCC is calling on the Ohio Attorney General, as the head of the Ohio Peace Officer Training Commission, to put a stop to these continued occurrences. To that end, today OFCC sent the following letter to Ohio Attorney General Nancy Rogers. |

Ohioans For Concealed Carry is very pleased to announce to our membership that we will have available use of a Firearms Training Simulator (FATS) to attendees at our Party in the Park annual members picnic on Sunday, August 3rd!
FATS uses audio/visual presentations to enable the user to develop marksmanship or targeting skills and/or judgmental skills in employing a firearm. The simulations are video depictions of a real life situation that a person might encounter.
The system uses a CO2 tether which provides realistic blowback to the simulated firearm which utilizes a laser to interact with the video screen. Weapon aim point, muzzle trace, shot location, and number of rounds fired are identified in the shot feedback screen display. The entire system is housed in a 10x10' tent.
Galileo Systems of Vermilion has partnered with OFCC to make this training simulator available free of charge to ticket purchasing attendees.
