The Columbus Dispatch recently reported that city attorneys have filed motions to have Phil Harmon’s lawsuit opposing the city AWB dismissed. The legal maneuvering centers around whether Harmon has standing to file the suit and if the Probate Court has any jurisdiction in the issue.

Harmon argues that the city AWB conflicts with the state concealed carry law. Conflicts with the ccw law have been hot topics on the forums and at many shooting ranges. Harmon also points out that as an attorney handling probate estates for clients he often must sell firearms from estates. The Columbus AWB bans the inheritance of any firearm that falls under the broad description of assault weapons in the law. Harmon is also quoted in the story as calling on City Council to resolve the issues through an amendment.

While Harmon’s request to City Council seems both reasonable and a common sense approach, Columbus gun owners already understand that the city council has no history of ever being reasonable or having any common sense when it comes to firearms issues.

A successful conclusion to the OFCC lawsuit against the City of Clyde posting the city parks could provide legal precedence in this case.
