Sub. S.B. No. 184 has been concurred by the Ohio Senate 25-7! This bill will now go to Governor Strickland for his signature, which he indicated he would consent to. Stay tuned for more information. Voted for the bill (25) Amstutz, Austria, Boccieri, Buehrer, Cafaro, Carey, Cates, Faber, Fedor, Goodman, Grendell, Jacobson, Mumper, Niehaus, Padgett, Roberts, Schaffer, Schuler, Schuring, Seitz, Spada, Stivers, Wagoner, Wilson, Harris Voted against the bill (7) Kearney, Mason, Miller, D., Miller, R., Morano, Sawyer, Smith The following is an abbreviated play-by-play of the Senate proceedings before the vote. Sen. Steve Buehrer (R-1) spoke in favor of the bill and explained several of the changes made by the House. Sen. Eric Kearney (D-9) spoke against the reduction in penalty for failure to notify a LEO in a situation where the LEO already knew you had a CHL and wanted his name removed from the bill as a sponsor. Sen Dale Miller (D-23) spoke against all of the amendments and said he favored the original bill as passed by the Senate. Sen. Lance Mason (D-25) said he agreed with Sen. Miller. Sen. Larry Mumper (R-26) countered Sen. Kearney's arguments reminding that it only applies if the LEO knew you had a CHL already and gave the example of running your plates before a traffic stop. Sen Tim Grendell (R-18) Asked for passage and supported the changes as clarifications intended to protect law-abiding citizens. Sen. Bill Seitz (R-8) Stated he supported the bill and reminded the Senate that many of the amendment provisions were originally in HB12 (the original CHL law passed in Ohio) before they were removed by attempts to appease the previous administration. Sen. Keith Faber (R-12) Supported the bill and also refuted Sen. Kearney's arguments Sen. Tom Roberts (D-5) asked Sen. Buehrer to clarify several amendments. Sen. Buehrer explained the changes to public building prohibitions, changes to the Class D prohibitions, and school zone changes. Sen. Faber wsa then asked to continue the explanations, particularly the exception for sealed or expunged criminal records. Sen. Capri Cafaro (D-32) Questioned how the tenant exception would affect those in public housing. Se. Faber stated any applicable Federal laws would supersede State law if there was a conflict. Sen. Cafaro also questioned the changes to the LEO notification, which Sen. Faber clarified. Sen. Cafaro then stated she would vote for passage of the bill. Sen. Robert Schuler (R-7) Urged concurrence and spoke in favor of the bill. Sen. Joy Padgett (R-20) was the final speaker and spoke very favorably of the bill. |
