Update on the new SAF lawsuit to get concealed carry through the courts by overturning the unconstitutional ban on CCW. (read more!)
The Preliminary Hearing on Sept. 7 went very well, although we were only given an hour and a half for both sides. We had a Magistrate, instead of the Judge Parrot as listed on the court's website, but this should not matter as long as she has an open mind. Our side had facts, their's had only rhetoric. The other side made mistakes and their one and only witness, an honest Trooper, confirmed under cross examination that he and other officers have different standards for enforcing these laws. This violates Ohio's equal protection and due process constitutional protections. In addition, the truthful officer admitted that those he arrested for being drunk with a gun or a prohibited person with a gun could also be charged under OTHER statutes even if our case prevailed. If the Magistrate is willing to listen to our arguments, we have a very good chance, even though a TRO carries a heavy burden of proof. A decision is expected within 10 days (by Sept. 17th).
